1. Acceptance of Terms

By accessing or using OrcaLayer ("the Service") at orcalayer.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

OrcaLayer is a data analytics platform that provides publicly available blockchain data analysis for Polymarket prediction markets. This includes wallet statistics, trading history, smart money tracking, and market analytics.

OrcaLayer is an informational tool only. We do not provide financial advice, investment recommendations, or trading signals. All data is derived from publicly available blockchain records.

3. Business Intelligence Tool

OrcaLayer is a Business Intelligence tool for analyzing prediction markets. We are not a bookmaker, exchange, or trading platform. We do not accept bets, hold user funds, or execute trades on behalf of users. All data displayed on the platform is derived from publicly available blockchain records and third-party APIs.

4. User Accounts

  • You may create an account using Google authentication, email magic link, or Ethereum wallet (SIWE)
  • You are responsible for maintaining the security of your account and credentials
  • You must be at least 18 years old to use the Service
  • One account per person; shared or automated accounts are prohibited

5. Subscription and Payments

OrcaLayer offers free and paid subscription tiers. Paid plans provide access to additional features as described on our Pricing page.

  • Subscriptions are billed monthly or annually
  • You may cancel your subscription at any time
  • Refunds are handled on a case-by-case basis
  • We reserve the right to change pricing with 30 days notice

6. Acceptable Use

You agree not to:

  • Scrape, crawl, or systematically download data from the Service
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service for any illegal purpose
  • Resell or redistribute data obtained from the Service without written permission
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated tools to access the Service beyond normal API usage
  • Use the Service, or any data obtained from it, to train, fine-tune, or evaluate machine learning models, large language models, or other AI systems, whether commercial or non-commercial
  • Create a competing product or service that substantially replicates the user interface, visual design, data presentation, or feature set of OrcaLayer

7. API Access

API access is available to Premium subscribers under separate rate limits and usage terms. API keys are personal and non-transferable. Abuse of API access may result in immediate termination without refund.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or timeliness of any data provided.

Trading in prediction markets involves significant risk of loss. Past performance of any wallet or trader does not guarantee future results. You are solely responsible for your trading decisions.

9. Limitation of Liability

In no event shall OrcaLayer be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to trading losses, lost profits, or data loss.

10. Intellectual Property

All content, features, algorithms, visual design, user interface, data presentation, and functionality of the Service are owned by OrcaLayer and are protected by intellectual property laws, including copyright, trademark, and trade-secret laws. You may not copy, modify, distribute, publicly display, or create derivative works based on the Service without our prior written permission.

Unauthorized cloning of the Service's user interface, dashboards, or data presentation will be pursued through legal channels including, but not limited to, DMCA takedowns, platform complaints, and civil claims.

11. Copyright Complaints (DMCA)

OrcaLayer respects the intellectual property of others. If you believe your copyrighted work has been copied and is accessible on the Service in a way that constitutes copyright infringement, please send a notice to [email protected] with the subject line [DMCA], containing the following information:

  • A description of the copyrighted work you claim has been infringed
  • The URL(s) or specific location on the Service where the allegedly infringing material is located
  • Your full legal name, address, telephone number, and email
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

We may also pursue DMCA takedowns against sites that clone the OrcaLayer interface, visual design, or copyrighted data presentation.

12. AI Training & Automated Data Collection Opt-Out

OrcaLayer expressly opts out of the use of the Service, its content, and any data obtained from it for the purpose of training, fine-tuning, evaluating, or otherwise developing machine learning models, large language models, or other AI systems.

This opt-out is a reservation of rights under applicable text and data mining (TDM) laws, including but not limited to Article 4 of EU Directive 2019/790 (DSM Directive). OrcaLayer additionally signals this opt-out through the X-Robots-Tag: noai, noimageai HTTP header and robots.txt directives where applicable.

AI companies, dataset aggregators, and automated crawlers are prohibited from ingesting, scraping, caching, or storing OrcaLayer content for AI training without prior written consent.

13. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
